Still in Probation Period | NO:EL Police Altercation Increase Imprisonment Possibility?

NO:EL is still in a probation period of his case from last year until June 2022 due to the accident in which he crashed into a motorcycle while driving in a drunken state in Mapo-gu, Seoul on September 7th, 2019 at 2-3 AM. The sentence he got for this accident was confirmed as neither the lawyer nor the prosecution appealed. If he is found to be drunk driving again this time, it means he committed the same crime during the probation period.

A lawyer at Seungjeon Law Firm, Min Hong-ki, explained “If the driver’s drinking is estimated to be a serious violation, police officers can decide to investigate the case further. If they refuse, they leave a record.” He also explained about NO:EL case, “He is not a first-time offender and has been sentenced to probation, then he committed a misdemeanor. There is a possibility that the investigators will seek an arrest warrant.” However, the crime he did is classified as a misdemeanor, not a serious violence, it means it is implausible for him to get prisoned. With that being said, NO:EL still continues his probation period and has to pay a fine in the new case.
